Since the bail system is not a standalone mechanism, it is one node in a much larger assemblage — that includes policing, prosecution, pre-trial negotiation, sentencing, incarceration, and community supervision. Each of these institutions has its own logic, its own incentives, and its own way of shaping the lives that pass through it. And the most consequential of them is, paradoxically, the one that is almost never discussed in public.

The Secret Architecture of Plea Deals

There is a dimension to this assemblage that rarely surfaces in public discourse, despite the fact that it determines the vast majority of outcomes: the plea deal.

Formally, this might be called something else — “pre-trial resolution,” for example. And although it’s hardly a ‘deal’ in favour of citizenry, it is nevertheless an arrangement often experienced as coercive and unjust.

The vast majority of Canadian criminal cases that do not go to trial are resolved via guilty pleas, many following some form of resolution discussion, and several Canadian reports estimate this share to be on the order of 90%. In the United States, the figure exceeds ninety-five percent.

Federal Judge Jed Rakoff, in Why the Innocent Plead Guilty and the Guilty Go Free, has documented how the plea bargain system has effectively transferred sentencing power from judges to prosecutors. This has produced what he describes as a “virtual extinction” of jury trials — down from nineteen percent of federal cases in 1980 to less than three percent by 2010, where it has remained.

The mechanism is straightforward and coercive. A person is arrested. Bail is set high enough that they are detained — despite the constitutional prohibition on excessive bail. Their defence lawyer, often meeting them for the first time at arrest, has limited access within the restricted visiting hours and arduous conditions of provincial jails. The prosecutor, meanwhile, charges the most severe offences that can be proven — unless the defendant agrees to plead guilty, promptly, to reduced charges.

The result is what Rakoff calls a “trial penalty.” Those who exercise their constitutional right to a trial and are found guilty receive substantially harsher sentences than those who accept a deal. The Supreme Court’s characterization of plea bargains as fair and voluntary contracts between relatively equal parties is, in Rakoff’s assessment, a “total myth.” It is closer to a contract of adhesion — one party dictating terms to the other.

Ben Austen captures this dynamic in Correction: Parole, Prison, and the Possibility of Change, observing that plea deals jumped from about eighty percent of criminal cases in the 1970s to ninety-five percent in subsequent decades. As Austen notes, a common joke in criminal justice circles is that you see more criminal trial rulings on TV in any given week than in the nation’s courtrooms.

This is an epistemological problem as much as a legal one.

Plea negotiations occur under solicitor-client privilege. They are inherently secret. We do not know, and cannot easily study, how many of these dispositions involve factual innocence, trumped-up charges designed to create bargaining leverage, or simply the rational calculus of a person choosing thirty days over a year of awaiting trial in conditions that defence lawyer Nader Hasan described as squalid and that judge after judge has described as unconscionable.

What we do know is that the daily docket of Canadian courts operates as an efficiency metric, not an effectiveness metric. The incentive is to move cases through, not to arrive at truth. Scholars like Nicole Myers have documented how the presumption of innocence has been functionally eroded in bail courts, where adjournments, procedural delays, and a culture of throughput render the daily docket a machinery of expediency rather than a forum for justice. When the system prioritizes throughput over accuracy, it is the most vulnerable — the unrepresented, the detained, the mentally ill, the addicted — who bear the cost.

Defence lawyer Hilary Dudding, on CBC’s Front Burner, put it plainly:

“If you’re faced with a year-long or more wait for a trial, but the prosecutor says, well, why don’t you plead guilty to a 30 day jail sentence, you could get out today ... Who would wait a year just to avoid that conviction?”

Who indeed. And what does it mean for the integrity of every statistic built on conviction rates when we know that the vast majority of those convictions were negotiated, not adjudicated?

Crime Control as Industry

The Norwegian criminologist Nils Christie argued decades ago that modern societies have turned crime control into a self-expanding industry — one that treats offenders as raw material and prisons as a growth market, sustained by political and economic interests rather than by actual crime levels. Christie’s thesis, articulated in Crime Control as Industry, is not a conspiracy theory. It is a structural analysis. When lawyers, judges, court reporters, bail supervisors, probation officers, correctional officers, managers, ministries, and the leadership that governs them all depend for their livelihoods on the continued existence of the system, there is a powerful — if largely unconscious — incentive for the system to perpetuate itself.

This is not to impugn the motives of individual workers. Many of them — I was one of them — enter the field because they want to help. But the structure within which they operate is not designed to shrink. It is designed to grow. And growth, in this context, requires a steady supply of human beings who have been classified as problems requiring management.

Christie also wrote about “conflicts as property” — the idea that the justice system steals disputes from the people involved and processes them through institutional machinery that serves the institution’s interests more than it serves the parties to the conflict.

The victim becomes a witness for the state. The accused becomes a case number. And the relational, human, deeply contextual nature of what happened between them is abstracted into charges, dockets, and sentencing guidelines. Austen illustrates this vividly in Correction: decades into a prison sentence, one person he profiles talked about the harm he’d caused, but it was as if he was speaking into the wind — by law, he couldn’t tell the actual people he hurt that he recognized the grief he’d caused. Prison, in a way, insulated him from taking responsibility for his crime.

The system separates rather than connects. It processes rather than listens. And it calls this justice.

Governing for the Outlier

Why do we do this? Why does social policy chronically focus downstream — on emergency rooms, on police responses, on carceral interventions — rather than upstream, on the conditions that produce the crises in the first place?

Part of the answer is cognitive.

The availability heuristic — a well-documented bias in which vivid, emotionally charged events loom disproportionately large in judgment and memory — ensures that a single horrifying case of someone out on bail committing another offence will shape public opinion more than a thousand cases of uneventful compliance.

As Shakir Rahim of the CCLA observed, nobody reports on the thousand people who met their bail conditions last month. It is both less arousing and more affectively engaging to focus on instances of sensational failure than on the quiet reality of a system that, for most people most of the time, functions without incident. Research on upstream approaches to social problems has long documented how this dynamic pushes resources toward visible emergency responses and away from the structural determinants that produce the emergencies in the first place.

Part of the answer is structural.

Institutions are locked into existing downstream infrastructures and funding streams — a form of path dependence. It is politically and administratively easier to add more prison capacity than to redesign housing, labour markets, mental health systems, or social protection. The visible crisis attracts the resources. The invisible upstream determinant remains abstract — until it produces another visible crisis.

And part of the answer is ideological.

Social policy in Canada, as in much of the Western world, tends to individualize social problems — to attribute poor outcomes to personal choices rather than structural conditions. This is the logic that Pierre Poilievre taps into when he said that if we just “take them off the street,” we can “reduce the crime rate dramatically.” It presupposes that crime is a characteristic of certain individuals, rather than a behaviour that emerges from certain conditions — conditions that the state itself has, in many cases, created or failed to address.

Poilievre, to his credit, even gestured toward this on the JRE podcast, acknowledging that the people cycling through the justice system are often the same people cycling through emergency rooms. But he drew the opposite conclusion from the one the evidence supports. Rather than seeing this overlap as evidence that criminal behaviour is downstream of health, housing, and social marginalization, he saw it as evidence that a small number of defective individuals need to be permanently removed.

This is the fundamental attribution error applied to an entire population. And it is precisely the kind of thinking that Christie warned would sustain the industry of crime control indefinitely.

The Cobra Effect (Perverse Incentives)

There is a parable in policy studies called the Cobra Effect. During British colonial rule in India, the government offered a bounty for dead cobras to reduce their population. Enterprising citizens began breeding cobras to collect the bounty. When the government discovered this and cancelled the program, the breeders released their now-worthless cobras, and the population increased beyond where it had started.

The current push toward tougher bail laws risks precisely this kind of perverse outcome. Bill C-14, the Bail and Sentencing Reform Act, is designed to make bail harder to obtain. It expands reverse-onus provisions, clarifies that the principle of restraint is not a “get out of jail free card,” and adds offences to the list requiring the accused — rather than the Crown — to demonstrate why they should be released.

As discussed in “The Bail Backlash,” retired Crown prosecutor Mike Murray supports the bill. Six Nations Police Chief Darren Montour wants it to go further. And defence lawyers like Nader Hasan predict it will lead to more people being detained, more bail hearings, more aggressive Crown postures, and — critically — more overcrowding in provincial facilities that are already operating beyond capacity under conditions that judges have repeatedly condemned.

The Front Burner episode ended by surfacing a judgment from January 2026, in which a judge reviewing conditions at a major provincial detention facility knocked more than a year and a half off a man’s sentence because of the conditions of his pre-trial detention. In her reasoning, the judge wrote that such reductions are becoming the norm rather than the exception, and asked:

“Politicians continue to urge that fewer people be released on bail and stiffer sentences be imposed on those found guilty of offences. My question is where are these people meant to go?”

This is the Cobra Effect in real time.

The political demand for toughness produces overcrowding, which produces sentence reductions, which produces the perception of leniency, which produces further demands for toughness. The system does not correct. It oscillates. And with each oscillation, the gap between work-as-imagined and work-as-done widens — a gap borne disproportionately by the overworked officers, the overwhelmed lawyers, and the human beings housed in conditions that make rehabilitation not just unlikely but structurally impossible.

There is always a gap between the good intentions of legislation and the reality of its implementation. A premier or federal leader who signals toughness is not acting out of malice — often they are acting out of the same helplessness the public feels. But good intentions, when they meet complex systems, can produce perverse incentives, unintended consequences, and a recursive cycle in which the cure feeds the disease. Scholars of penal appetites have been describing this pattern for longer than I have been writing about it. What is new is the scale of the audience now receiving the simplified version.

What a System That Worked Would Look Like

In my years of casework, I had clients who, against all odds, turned their lives around. They checked in, they did the work, they built something from the wreckage. And almost invariably, the ones who made it described the same desire: to help others going through what they had survived. To coach, to mentor, to guide. To become, in a word, what a community corrections worker aspires to be — someone who walks beside you.

This is not a sentimental observation. It is a design principle. A system that genuinely rehabilitated would produce graduates who could lead the next cohort. It would build in feedback from the people who have actually experienced its interventions — not as an afterthought, but as a core mechanism of organizational learning. It would be designed to shrink over time, not to grow. And it would measure its success not by how many people it processes, but by how few it needs to.

Imagine, for a moment, someone who has been through the system — accused, detained, convicted, supervised, and eventually released. Imagine they have done the difficult, invisible work of rebuilding their life. At present, this person has no meaningful channel through which to feed their experience back to the system that shaped them. In theory, complaint mechanisms exist — ombudspersons, correctional inspectorates, formal grievance processes. But these bodies typically lack enforcement teeth, and the culture of corrections is one of reticence: self-identifying as a critic of a system that still holds power over your record, your conditions, and your reputation is a risk most people rationally choose not to take.

There is no exit survey from parole or probation. There is no feedback loop that says, How did we do? What helped? What harmed? The system extracts information — through pre-sentence reports, risk assessments, case notes — but it is never changed by what it extracts.

A well-organized system is one that understands itself. That formulation keeps returning to me because it captures what is missing. Understanding requires listening. It requires what Epictetus gestured toward two millennia ago — hearing twice as much as we speak.

That kind of system would threaten every incentive structure currently in place. It would challenge budgets, bureaucracies, careers, and — most importantly — the story we tell ourselves about who those people are.

Because here is the uncomfortable truth at the centre of all of this: “criminals” remain one of the last social groups it is openly acceptable to loathe, to dehumanize, to treat as categorically different from the rest of us. We have, rightly, developed norms against discrimination based on race, gender, sexuality, disability, and religion. But conviction — or even accusation — strips a person of the moral consideration we afford to everyone else.

As Austen documents in Correction, the United States has created a rigid caste system in which felony convictions produce cascading barriers to employment, housing, public assistance, voting, and jury service. Canada’s version is softer in degree but identical in kind.

And the bail system is the front door. It is the purgatory through which anyone who has an allegation made against them might pass. Police do not need proof beyond a reasonable doubt to lay a charge. They need reasonable and probable grounds. You can be charged on someone’s word alone.

Which means that the distance between you and that purgatory is shorter than you think.

A System That Understands Itself

I began the first article in this series with a question borrowed from software engineering: is this a bug or a feature? Is the criminal justice system malfunctioning, or is it producing exactly the outcomes it was built to produce?

I think it’s both. The people within the system — the officers, the lawyers, the judges, the social workers — are overwhelmingly trying to do good work under impossible conditions. They are burnt out, overworked, under-resourced, and operating within organizational structures that prioritize compliance over meaning. This is the gap between work-as-imagined and work-as-done — a gap I have spent my doctoral research and my career trying to understand.

But the system itself is not designed to learn from the people it processes. It is designed to process them. It has no meaningful feedback loop from its clientele to its decision-makers.

Right now, we are doing the opposite of listening. We are speaking over the people who know the most about what the system actually does to human beings. We are letting slogans substitute for understanding. We are letting the availability of horror stories substitute for data. And we are allowing politicians to offer incapacitation as if it were wisdom, when what it actually is — and what it has always been — is the most expensive, least effective, and most humanly devastating option available.

A justice system worth the name would be one that, over time, needed less of itself. Not because it ignored harm, but because it addressed the conditions that produce it. Not because it was soft, but because it was intelligent — responsive to feedback, honest about its failures, and humble enough to learn from the people it has processed.

That system does not yet exist. But imagining it is the first step toward building it. And refusing to accept the slogan is the first step toward imagining it.

On March 19, 2026, Pierre Poilievre sat across from Joe Rogan and delivered a line that would circulate across every platform within hours.

“We got to toughen up our justice system. It got way too soft,” he said.

What followed was a compressed, confident, and deeply misleading account of bail in Canada — one that collapsed an entire legal apparatus into a single, intoxicating claim: “In Vancouver, they had to arrest the same 40 guys 6,000 times in one year. 40 guys, 6,000 arrests.”

Rogan, predictably, called it “bananas.” The audience, predictably, agreed.

And just like that, the most complex, contested, and consequential intersection of law, liberty, human suffering, and institutional failure in Canadian public life was reduced to arithmetic.

Forty people. Six thousand contacts. Remove them. Problem solved.

I don’t wholeheartedly disagree with Poilievre. There is a small cohort of people who cycle repeatedly through the criminal justice system, and their stories are real, their harms tangible, their visibility to frontline workers undeniable.

I spent years working in community corrections — supervising people on bail, probation, and parole. I’ve watched the revolving door from inside the building. I’ve written the pre-sentence reports. I’ve sat across from people on their fifth, tenth, fifteenth-plus charge. I know the frustration that lives in Poilievre’s rhetoric, and I know why it resonates.

But I also know what that rhetoric conceals.

What I challenge — emphatically — is the framing. The superficiality. The absence of the kind of consideration that anyone who has actually worked inside this system would immediately recognize as missing.

Poilievre isn’t telling a lie, exactly. He’s telling a story so selective that it functions as one.

Two Stories, One Silence

Within twenty-four hours of the JRE episode dropping, CBC’s Front Burner aired an episode called “The Bail Backlash.” It is, in many ways, a competent counterpoint — more measured, more multi-voiced, and substantially more honest about what we do and do not know.

The Front Burner piece introduces listeners to Ron and Meechelle Best, who lost their daughter Kelly in a crash caused by someone out on bail who had already breached his conditions multiple times. Meechelle’s testimony is devastating:

Three times he was given bail. Three times he walked away. Why does someone who shows no respect for the law, the police, the judges or for society keep getting another chance?

That is a real question and it deserves a real answer — not a slogan.

But what the Front Burner episode does well, and what the JRE interview struggles to do at all, is hold multiple truths simultaneously. It introduces retired Crown attorney Mike Murray, who argues that the balance has been lost. It brings in Shakir Rahim of the Canadian Civil Liberties Association (CCLA), who points out that we hear about every failure and none of the successes — because compliance doesn’t make headlines.

And it features defence lawyer Nader Hasan, who represented Umar Zameer, the man acquitted of all charges after being accused of intentionally killing a police officer — a case where premiers and mayors publicly denounced bail being granted, only for the Crown’s case to fall apart at trial.

Hasan’s observation is worth sitting with:

You don’t want to talk in the abstract, so let’s not talk in the abstract. When you say someone’s bail is denied, what that means is you are throwing them in a prison with horrific conditions for what may be three years until they can get to actual, actual trial.

Both of these media artifacts — the JRE interview and the Front Burner episode — flatten complexity. But they do so in different and predictable directions. JRE collapses the system into actors (repeat offenders) and arrives at a solution of incapacitation: remove the bad actors, crime drops. Front Burner expands the system into processes (courts, rights, delays, conditions) and arrives at a solution of calibration: adjust the balance, protect the vulnerable.

Neither asks the harder question.

The Question Nobody Is Asking

The question is not “Is bail broken?”

The question is “Broken relative to what objective?”

Because consider what we already know. According to Statistics Canada, more than seventy percent of people in provincial jails across this country are being held on pre-trial detention — a figure that has climbed to nearly eighty percent in some provinces, according to the CCLA. They have not been convicted of anything. They are, in the language of law, “legally innocent”.

This is not a marginal statistic. It is the defining feature of provincial incarceration in Canada. And it has been growing for decades.

Holly Pelvin, in her landmark 2019 study of 116 remand prisoners across four maximum-security provincial facilities, documented what this looks like on the ground. Her research reveals a cross-institutional system of punishment that begins at arrest, intensifies through court appearances conducted under conditions of physical pain and psychological degradation, and compounds through daily life in overcrowded cells where lockdowns sever the most basic human need: communication.

Pelvin’s respondents described court days as among the most visceral experiences of their detention — woken at five in the morning, strip-searched, shackled to other prisoners, transported in steel-box vans, given a granola bar for lunch, and often returned to their units after evening lock-up, unable to access phones or showers. One participant was arrested while swimming and was forced to appear in court in a bikini—covered by a paper jumpsuit—repeatedly. Ostensibly, because she had not yet been convicted and therefore was not yet entitled to the prison-issued garb reserved for ‘true criminals’.

Ontario Court of Justice data show that in 2025, about 56% of cases that began in bail court were ultimately withdrawn, stayed, or otherwise resolved without a conviction. These are people whose lives were disrupted — housing lost, children unattended, employment severed, relationships frayed.

In theory, oversight mechanisms exist: ombudspersons, inspectorates, complaint processes. But in practice, these bodies rarely have enforcement power, and the terrain is rife with reticence.

Filing a formal complaint means self-identifying within a system where you are already vulnerable — where being labelled a complainant can invite scrutiny rather than resolution, where the process itself adds to the bureaucratic weight of an already interminable wait, and where the stigma of having been accused in the first place discourages the very people with the most to say from saying it.

The result is that for most people who pass through remand without a conviction, there is no meaningful recourse — not because none exists on paper, but because the conditions under which it might be exercised are structured, however inadvertently, to discourage its use.

The Front Burner episode deserves credit for surfacing data that complicates the “too soft” narrative. Provincial numbers show that the percentage of people being released on bail has actually fallen since 2018, from fifty-seven percent to fifty percent.

Recent CBC reporting using freedom-of-information data found that close to eighty-two percent of all prisoners detained in 2024 were on remand. More people are being detained before trial, not fewer. Yet the political consensus is that the system is too lenient.

As Rahim observes:

We don’t actually collect any data about the number of people who are released on bail and allegedly re-offend. So if you were to go to the Minister of Justice and say, ‘hey, can you show us over the years, you know, how the situation has gotten worse’ ... They can’t answer that question.

This is not a detail.

This is the basic foundation upon which the entire debate rests — and it is hollow. We are making sweeping legislative changes based on affective intensity, not empirical clarity.

Liars Figure, and Figures Lie

Poilievre’s “40 guys, 6,000 arrests” claim has been fact-checked multiple times.

The actual figure, confirmed by Vancouver Police, refers to approximately 6,385 “negative police contacts” — a category that includes suspects and charges recommended, not literal arrests. The timeframe is unclear. The offences are overwhelmingly property crimes. As one legal analysis noted, arresting 40 people 6,000 times in a single year would be physically impossible. It is, in the most generous reading, a compressed truth. In the less generous reading, it is a statistic engineered to produce outrage.

But the deeper problem isn’t the number. It’s the logic. Poilievre’s argument rests on what psychologists call the fundamental attribution error — the tendency to explain behaviour as a property of individuals rather than a product of circumstances. If we can just identify the bad actors and remove them, the logic goes, the system works. This is seductive because it is simple.

It is also wrong.

The criminological evidence on this is extensive and consistent. Cross-national comparisons compiled by Public Safety Canada show that crime rates and incarceration rates do not move in lockstep. The United States experienced its largest crime drop through the 1990s while simultaneously incarcerating more people than any nation in history. Canada’s crime rate and incarceration rate both declined after the early 1990s. England and Wales saw both rise together. The same crime trajectories coexist with wildly different incarceration patterns and vice versa, which means that locking people up is, at best, one variable among many — and, at current levels, one with diminishing returns.

A 2014 review by the National Academies of Sciences found that estimates of incarceration’s crime-reducing effect have fallen substantially over time and are small in magnitude at current levels. Some econometric studies even find that marginal increases in prison populations are associated with increases in crime, suggesting negative returns at high incarceration levels.

None of this means that some people should not be detained.

It means that detention as a strategy — as the centrepiece of a justice platform — is intellectually bankrupt. And it means that anyone offering “jail, not bail” as a policy position is either unaware of this evidence or indifferent to it.

The Drive Home

I want to tell you about a pivotal moment early in my career.

Working within ‘community corrections’, I conducted a pre-sentence investigation — the kind of deep, biographical interview that helps a judge understand who is standing before them, not just what they’ve been charged with. The client had been convicted of an assault. My job was to compile the facts, the history, and the context.

What I was not prepared for was what emerged in the course of that conversation. This person — the ‘offender’, as the system would have me think of them — disclosed, for the first time in any formal setting, that they had been the victim of serious abuse in childhood.

The drive home that evening was long. I felt sad and shattered and confused. Because here was the system telling me that perpetrators and victims are different categories — neat, separable, administrable. And here was a human being telling me, through their story, that they are often the same person.

This was not the last time it happened. It was the first of many. And each time, the same dissonance: the system requires you to see someone as a client in need of correction, a moral agent who has offended the majority and must be disciplined accordingly. But the person sitting across from you is someone who hurt because they were hurt, who didn’t know what to do with their pain, and whose best wasn’t good enough — but who nevertheless was trying.

The criminal justice system would have us believe that this complexity is an exception. It is not.

It is the rule.

“Hurt people hurt people” is not a cliché.

It is a research finding. And until our politics can hold that finding without flinching, we will continue to build systems that punish suffering and call it justice.

The question I want to leave you with now is simple but uncomfortable:

If you were arrested tomorrow — wrongly, on someone’s word — and held for months or years in conditions that Canadian courts have called intolerable and degrading, would “jail, not bail” still feel like common sense?

The Falling Walls pitch competition, featured in last week’s post, was quick, sharp, and merciless—three minutes of stage time. Just enough to explain why “peer” means more than chatting with your buddy.

As the saying goes: you win, or you learn. We didn’t win, so here’s some hard-earned wisdom.

People seem to think our social enterprise is merely about ‘peer support’. They imagine the usual pat on the back after a critical incident—“You good?”—followed by the automatic “Yep.” Curtain falls, problem solved. Right?

But that script is broken. It props up silence, rewards stoicism, and trains people to believe that keeping quiet is the only safe move. It soothes individuals while leaving the system untouched.

We’re after a fundamental redesign. At Frontline Peer, we’re flipping the script to champion “peer” for 21st-century operations. Think of the concept in 3D:

• Collegial debriefing—real conversations with professionals who ‘get it’ where truthful candor advances your career rather than sinks it1.

• Peer-to-peer architecture—decentralized information sharing (think BitTorrent or blockchain) where professionals are both clients and servers, uploading and downloading hard-won wisdom, in real time.

• Peer review—the rigorous, double-blind, academic kind. Ideas tested on substance, not on rank, title, or how shiny the badge is on your chest.

Put together, what we’re building is an infrastructure that combines all three. It’s psychological safety meets organizational responsivity: a system that listens, learns, and adapts instead of repeating the same old face-palms.

So here’s to rebranding peer—not as a hug or as a hotline—but as a living network where frontline perspectives generate collective intelligence, and public safety organizations finally catch up to the contemporary century.

What happens when an airplane crashes?

In aviation, the black box preserves data so disasters aren’t repeated. It’s called organizational learning¹. Simply put, it’s about learning from failure.

We’re taking that same idea to public safety—because right now, the very people sworn to protect us are breaking down. Police, paramedics, firefighters, 911 dispatchers—who dedicate their lives to serving others—endure alarming rates of PTSD, burnout, and fractured families pile up.

In Ontario alone, paid stress injury claims rose 35% in just five years², now costing an estimated $35 million annually. Scale that nationally and the burden tops $100 million of your hard-earned tax dollars each year! But the real cost? Lives cut short, families broken, communities left less secure.

Here’s the irony: most injuries don’t come from dangerous calls but from red tape. It’s the cumulative strain of endless paperwork, organizational strife, and—most corrosive—reticence baked into the culture.

Silence, the absence of psychological safety³, breeds what scholars call institutional amnesia. Every time someone burns out or retires, hard-earned knowledge disappears from the organization they leave. It’s like burying one’s head in the sand when decision-making matters most: call it the “Ostrich Paradox”⁴.

Frontline Peer began with a simple idea.

Working in the justice system, I saw how systems were set up to fail. Caseloads cycled endlessly through probation and parole, and only “failures” ever reappeared in my windowless office. Over time, confirmation bias hardened correctional cultures into cynicism ^4,5.

Here’s the irony: we measured everything except what mattered. Car garages hand out feedback surveys after an oil change, yet in prison work, no administrative survey ever asked clients, post release—how did we do punishing you?

Cynical? Maybe. But what could we learn if we took that approach—if we dialogued with wrongdoers about harm, and it's potential for capacity building? ⁶

Fast forward to today’s corporate environments. Liability management, blame, and reputational risk dominate. Accountability trickles down as finger-pointing rather than justice ⁷. I didn’t have the words for it then. But after some PhD reprieve, I see it clearly now: public safety personnel are burning out, with stress injury claims and time off work as the social proof ¹.

Why Frontline Peer

I founded Frontline Peer as a space to develop insight from the ground up, drawing on “tacit knowledge” ³—the kind bureaucracies can’t quite grasp.

Correctional workplaces are a prime example: psychosocial hazards are baked into the environment ⁸. Literature shows probation and parole officers—like I once was—experience most of their stress not from clients, but from “administrative harms” that choke the work people find meaningful ⁹. Colleagues echo the same finding: three-quarters of stressors come not from casework, but from often the nonsensical bureaucracy itself ².

That recognition showed me my own need for wellbeing. And it’s why Frontline Peer exists: to preserve, translate, and mobilize frontline knowledge into tools for wellness, resilience, and operational insight.

When Did Being Well Become Just Another Checkmark?

We’re still hunting for an illustrator who can capture absurdity—because frontline experience deserves more than AI filler. So, if you can draw, step up here. Its part of our mission for responsive recognition. Recognition matters, and that’s exactly what’s at stake this week: the moral injury that happens when workplace behavior collides with personal values¹. It’s not “burnout.” It’s a fracture in purposeful leadership². If there’s one thing we all have in common, it’s the desire to be well—and recognition is key to that shared human condition³.

Here’s the irony: public safety workers sign up to keep everyone else safe, and in return, they inherit ill-being as a real occupational hazard^4,5. The data keep stacking—disproportionate stress injuries and mental health disorders among the very people sworn to prevent harm⁶. Their environments don’t just expose them to risk; they sometimes manufacture hazards wholesale⁷. It’s cultural—shaped by values, behaviors, and distorted priorities⁸.

The field itself can’t even escape the paradox, since “safety” is more often described by its absence than presence, the tendency is tally up failures rather than measure success⁹. In brief, blame gets situated on people rather than the real work of interrogating systems¹⁰.

So, at Frontline Peer we’ll keep punching-up, siding with those who need reprieve—especially when taking time-off gets framed as ‘gaming the system’¹¹.

Maybe the question isn’t whether workers are resilient, but whether systems are designed to meet people’s needs in the first place¹².

Hidden in Plain Sight: Dispatches to Nowhere

Frontline Peer tips its hat this week to Natalie McLeod, whose illustration nails the visual syntax of public secrecy¹—and drives home the punchline: clients and practitioners alike are trapped in systems that claim to manage risk but mostly manufacture chaos. Paradoxes abound this is a story about systems, not scapegoats.

Probation, parole, and their community-corrections cousins (bail, diversion, supervision, etc.) sit awkwardly between coercion and care². Staff get reduced to ‘street level bureaucrats’^3—moonlighting as ‘third-party police’⁴—stuck in endless social triage⁵. Meanwhile, risk logic bears down hardest on those already carrying multiple disadvantages⁶.

The comic captures a liminal space—”hidden in plain sight”⁷— and begs the question: is it a feature or a bug? The same clients who shuffle through the justice system rotate through ER waiting rooms⁸. Hospitals triage people in, prisons triage people out. Sometimes, prison is even sought as a temporary refuge from the streets⁹. Crazymaking, no?

And inside the system? Not much brighter. First responders are burning out at alarming rates and in need of recognition and care¹⁰. Meanwhile, McJustice is served like a drive-through^11,12—or worse: a treadmill that never stops running¹³.

Then, three Witness Statements from the inmates who swear they saw nothing—each now required to attest they indeed saw nothing. Seventy-three minutes and four signatures later, Sully finally calls medical. The inmate survives. Sully logs two hours of overtime and documents everything by the book. Policy says: “life-threatening incidents require immediate action.” Turns out, the immediate action was paperwork. Promotion pending.

Bi-weekly while you sip that Friday morning corporate coffee—we’re serving safety ironies steeped in Reason1, meant to provoke thought, spark debate, and give us all a laugh.

Because if you ain’t laughing, you’re crying—or worse—filling out a Form 27-B.

In this canteen special: the so-called “iron cage” of rationality, as Max Weber once put it—and as many penal practitioners might mutter under their breath. Folks sign up for prison work with visions of helping people, only to find themselves trapped in a system obsessed with efficiency metrics, risk formulas, and control policies that treat “people” as policy items.

The irony for human-service fields like corrections is sharp: most start out as “people people.”2 But the toll of administrative harms3—the endless forms, audits, and justifications—can make even the most dedicated public safety personnel unwell4.

Police, paramedics, and countless practitioners get disillusioned by paperwork creep. As one cop was quoted saying in a recent piece: “It’s frustrating… I didn’t join to sit behind a desk.”5 She speaks for thousands in law enforcement, and beyond.

Here’s the paradox: people join for the casework and stay for the people. They leave when the work turns into proving they’re working, one PDF at a time.

Apparently my subconscious now moonlights as a literary critic when I'm not feeding the bureaucratic machinery that is government—or, by extension, university. But don’t let a bit of cynicism put you off!

Here's the revelation that hit me like a poorly-filled incident report: workplaces aren’t broken — they’re working exactly as designed. The chaos isn't a bug, it's a feature. We've built systems so perfectly dysfunctional that they'd make the Bard weep with artistic envy.

So, I defer to literature:

"Lord, what fools these mortals be!" While Shakespeare was mocking love-drunk fools. He clearly never met a safety committee.

What’s Your Frontline?

By “frontline,” I don’t mean some noble battlefield metaphor.

It’s the psychosocial crime scene where critical thinking gets assassinated by policy manuals, and common sense outranks science.

It’s where:

• Safety meetings represent the most common workplace hazard

• Forms breed faster than rabbits on Adderall

• “Best practices” are neither best nor practiced

• Folks closest to the problem have the least power to fix it

• Success is invisible, but failure gets a PowerPoint presentation

You’re not frontline workers — you’re crisis archaeologists, digging through bureaucratic layers to uncover the actual human underneath. Congratulations!

As safety-critical personnel, you’ve chosen a profession where doing your job well means no one notices, and doing it poorly might earn you a promotion or an even deeper seat in to the bureaucracy.

The ‘Frontline’ is where or when organizational intent becomes action, whether through direct public engagement or instant operational support (behind the scenes).

It refers to:

1. anyone whose work directly affects the public or service outcomes in real time, whether through face-to-face contact or immediate operational advice

2. the point where an organization meets the outside world—through customer contact or roles that shape human service provision at any given moment

3. roles defined by immediacy and impact—spanning both direct service and critical support functions that determine real-time outcomes

We’re kicking things off with “correctional” vignettes, partly because it’s my specialty, and partly because if you can make fun of prison bureaucracy—it is the Mount Everest of institutional absurdity—you can make anything funny.

Rethinking Governance: Why Governance Needs Morality

Governance is more than a mechanism of control. At its core, it should be a moral endeavor, balancing the power to act with the wisdom to act justly. As Zygmunt Bauman observed, politics concerns knowing what to do, while power represents the capacity to do it. Governance exists at the intersection of these forces, but all too often, it prioritizes efficiency and control over morality and engagement.

In our conversation, Don and I reflected on the evolution of governance in public safety, tracing a shift from community-centered approaches to surveillance-driven models. This transformation, we agreed, has left gaps in the system, undermining trust and human dignity. To address these challenges, governance must reclaim its moral foundation.

The State of Public Safety: From Community to Surveillance

Public safety once emphasized relationships and community connections. Don described his early days in probation, where officers worked closely with local leaders and clergy. “There was an older group of men who were much more community-connected,” he recalled. These relationships were central to building trust and fostering rehabilitation.

Over the years, this human-centered approach gave way to professionalized, mechanized systems. In his 1974 essay, Computerized Crime Control or Community Control of Crime, Don warned of the risks posed by technocratic governance. Today, those predictions have come to fruition, with surveillance technologies dominating probation and public safety work.

“Mass supervision in the community, without a clear purpose beyond simply tracking and knowing clients’ whereabouts,” Don remarked, highlighting the superficial nature of client interactions with ‘supervisors’ rather than in a relationship with human service providers. This shift in technocracy prioritizes surveillance over meaningful engagement, reducing individuals to data points rather than addressing their unique needs and potential.

Morality and the Force of Law

Central to our discussion was the idea that governance has divorced morality from law. “The only way we have to use control is law, since we seem to divorce morality from law,” Don noted. This separation leads to systems that enforce rules without considering the ethical principles behind them.

One consequence is the erosion of the therapeutic alliance—the relationship between probation officers and clients. This alliance, once the cornerstone of rehabilitation, has been overshadowed by administrative tasks and surveillance. Officers now spend more time at their desks than in the field, managing cases rather than building trust.

We agreed that effective governance must reintegrate morality into its systems. Laws alone cannot address the root causes of crime or foster meaningful change; they must be guided by ethical considerations that prioritize human dignity and well-being.

Language, Truth, and Public Discontent

Language plays a critical role in shaping governance and public trust. Don expressed concern about how political discourse has weaponized language, distorting truth and fueling public discontent. “What I get more concerned about is the linguistic side of it all... and how it’s been weaponized in the political arena,” he said.

This manipulation creates frustration rather than informed dissent. Words like “rehabilitation” have lost their meaning, replaced by metrics and jargon that prioritize control over care. The public, alienated by this rhetoric, becomes disillusioned with popular governance, seeking reactionary solutions rather than transformative change.

Economic Control and Social Mobility

Our conversation also touched on the economic dimensions of governance. Don described economic disparity as a deliberate form of social control: “Disparity in wages, disparity in taxes... is a form of social control.” These inequalities, he argued, reinforce existing power structures, limiting social mobility and perpetuating systemic inequities.

Governments often respond reactively to crises rather than addressing their root causes. “I have a hard time finding a lot of proactivity… For one thing, they don’t have the capital,” Don observed. This reactive stance exacerbates instability, prioritizing short-term solutions over long-term strategies for equity and inclusion.

Towards Morally Informed Governance

What would it take to create governance systems grounded in morality? Don emphasized the need to recover “a sense of humanity” in governance, balancing technological capabilities with ethical principles. This approach requires viewing individuals not as problems to be managed but as people with dignity and potential.

Don’s career-long advocacy for the therapeutic alliance offers a blueprint for this vision. By fostering relationships and trust, governance can move beyond reactive measures, addressing the root causes of crime and inequity while promoting rehabilitation and growth.

Conclusion: A Call for Balance

Our dialogue revealed the importance of balancing tradition and innovation, morality and efficiency. Governance must reclaim its moral foundation while embracing the tools and technologies of the modern age. This balance is essential to fostering systems that are both effective and just.

Governance, as Don put it, is a negotiation between the capacity to act and the wisdom to act well. By prioritizing morality, engagement, and equity, we can create systems that empower individuals and communities rather than control them.

Understanding Negativity Bias

One of the key observations that underpins Frontline Peer is the impact of negativity bias—the tendency to focus disproportionately on failures or adverse outcomes while overlooking successes and strengths.

In the criminal justice context:

1. Practitioners: Often encounter individuals at their most vulnerable or when things go wrong. Over time, this creates an institutional lens that highlights failures and diminishes the visibility of positive outcomes.

2. Media and Public Perception: The narrative around criminal justice is frequently framed in negative terms, overshadowing the hard work, successes, and human stories on all sides of the system.

This creates a negativity cycle that can lead to ‘spiraling incivility’.

Why This Matters

Negativity bias perpetuates burnout, erodes morale, and fosters a one-dimensional understanding of justice work. It creates a culture where challenges are seen as insurmountable rather than as opportunities for reflection and learning.

For correctional workers, there is a tendency to see cases of re-offending rather than successes by those who have desisted from crime and moved on.

Frontline Peer seeks to counter this bias by creating a space to elevate stories of resilience, insight, and collaboration. Through collective reflection, we can better understand the human side of systems and recognize the dignity in all contributions.

Principles of High-Reliability Organizing

Inspired by research in safety science and high-reliability industries, Frontline Peer bridges the gap between criminal justice systems and learning cultures by incorporating the five principles of high-reliability organizing:

• Preoccupation with Failure: Embracing challenges as opportunities to build resilience.

• Reluctance to Simplify: Recognizing and respecting the complexity of sociotechnical systems.

• Sensitivity to Operations: Staying attuned to the realities of daily experiences.

• Commitment to Resilience: Growing and adapting through challenges.

While the criminal justice system exemplifies the first principle well—preoccupation with failure—Frontline Peer fosters dialogue and exploration to integrate the remaining four principles, creating a more holistic and adaptive approach.

The Unseen Challenges in Public Safety Work

Public safety personnel (PSP) are often hailed as unsung heroes. From first responders to dispatchers and search and rescue teams, these individuals face unique stressors that often go unnoticed. In this issue, we explore the realities and occupational stress injuries (OSIs) affecting PSP, who encounter personal, operational, and organizational pressures in their roles.

What Are Occupational Stress Injuries?

OSIs are mental health challenges that arise from the intense stress PSP experience, including conditions like PTSD, depression, and anxiety. The constant exposure to traumatic events—whether it’s a paramedic handling a fatal accident or a parole officer with a heavy caseload—has profound impacts on mental health.

Policy vs. Reality

As sociologist Zygmunt Bauman noted, policy is about knowing what to do, while power is the capacity to do it. In public safety, a disconnect often exists between policy and practice. Standardized approaches frequently overlook the human-centred needs of people. Mental health programs may be available, but access is frequently limited, stigmatized, or misaligned with actual needs. Frontline Peer is committed to bridging this gap by sharing real experiences and insights from PSP.

Organizational Responsivity

Borrowed from correctional intervention theory, “responsivity” refers to how well organizational programs meet the needs of employees and service users. Ideally, organizations would provide comprehensive, individualized support. However, many PSP report feeling unsupported, leading to burnout, frustration, and even attrition. Addressing these gaps is crucial for resilience and long-term retention in public safety.

Emerging Concepts in Safety Science

Building resilience isn’t about creating tough individuals—it’s about creating supportive environments. Resilience engineering and high-reliability organizing are concepts borrowed from the military and aviation sectors and are now applied in corrections and public safety. These approaches focus on anticipating challenges and preparing systems to adapt and recover, providing valuable insights into how PSP organizations can better meet the demands of complex, high-risk roles.

Innovations in Peer Support

Peer support programs, such as Critical Incident Stress Management, often meet with mixed reactions among PSP. While connecting with colleagues who understand their experiences is essential, there are concerns about formal programs missing the mark. Informal support networks within trusted circles are often preferred, but these can sometimes reinforce unhealthy coping mechanisms. As research into peer support continues, we aim to inform you about best practices and emerging insights.

PSP Culture: Rethinking Strength and Resilience

Stoic ideals of strength and toughness often dominate PSP culture. True resilience is about achieving a well-lived life rooted in authentic self-awareness and mental well-being. This issue of Frontline Peer explores how cultural beliefs can create barriers to seeking help, adding to the psychological toll of the profession. Redefining these ideals could be key to healthier workplaces and supportive PSP environments.

The Realities Behind the Badge

Occupational stress, exacerbated by minimal psychological support and administrative harms, affected many facets of my life, especially as the job spilled into my relationships. The cumulative impact of stress felt like “death by a thousand cuts,” echoing a warning often shared by a trusted colleague and mentor who I recall also stating the need to “maintain boundaries and lower expectations.” Each traumatic case, each moment of professional overreach, wore away at my sense of self and whittled down the idealism that first drove me to the work. Over time, I saw the illusion of infallibility upheld organizationally, a myth preserved at the expense of transparency and genuine support. When the weight of these burdens became unsustainable, I recognized the need to step back, reassess, and ultimately, seek a path forward that balanced my purpose with well-being.

Founding Frontline Peer: A Space for Real Stories

I am in the process of creating Frontline Peer, a social enterprise aimed at responding gaps witnessed—built upon principles by Steven Shorrock’s The Varieties of Human Work, where “work-as-imagined” clashes with “work-as-done.” With my background in criminology and psychology and my current interdisciplinary studies, Frontline Peer aims to provide public safety personnel a safe, anonymous space to share their triumphs and struggles—as well as celebrate and champion accomplishments. Here, voices and truth matters. In founding this platform, I wanted to create a space for professionals to reveal their lived experiences without fear, helping them avoid the isolation and disillusionment I faced in silence. Said differently, I see a problem where reticence is encultured by PSP generally despite the fact that their stories represent vital resources to improve emergent concepts in safety science known as reliability-organizing and resiliency engineering.

Redefining Support in Public Safety

My recovery journey is reshaped by an approach to public safety, focusing on studying human factors, ergonomics, and user-centred design principles. This interdisciplinary path brings me to the Ocean and Public Safety Laboratory at Memorial University of Newfoundland’s Fisheries and Marine Institute. Here, I study how safety principles from high-hazard industries, including seafaring, aviation, and the military, offer a new lens through which to view the demands of public safety work.

One compelling intersection has been the design principles of confined spaces, and how they parallel prison environmental architecture. Just as ships are designed for functionality within tightly controlled, sometimes claustrophobic spaces, correctional facilities operate with similar constraints. These socio-technical environments share unique challenges: both prioritize control, safety, and the need for operational readiness while operating within rigid, unyielding boundaries that test the physical and psychological endurance of those who work within them. The overlap in these design principles underscores the critical importance of user-centred design, which can profoundly impact the well-being and resilience of individuals navigating operations in these spaces.

My interest in survival and the human element of operations in maritime industrial practices and lessons related to situational awareness, crew safety, and confined space ergonomics all of which offer insights into my own public safety practices in probation/parole. Therefore, I find inspiration in my scholarship through works like The Theater of War by Bryan Doerries, which explores cathartic storytelling among military veterans. Borrowing from patient safety protocols in healthcare and training from high-hazard industries including nuclear power, I am noticing how these principles can better equip PSP—not just those on the front lines but also the many individuals who work to keep these systems secure, functional, and resilient.

Through Frontline Peer, I aim to foster a deeper understanding that respects the complexities of high-risk work environments. By grounding our practices in human-centred and interdisciplinary principles, we can build systems that recognize the unique needs of those who inhabit these spaces.
